Reminder for Prepare Form E
It is time to start preparing the Form E [Return Form of Employer – Remuneration for the Last Calendar Year]!
Employer’s Responsibilities
If you have an employee during last year, it is mandatory to submit Form E (Borang E) to LHDN (Inland Revenue Board, IRB) by upcoming 31 March.
For Companies, LLP, Trust Bodies and Co-operative Societies – It is mandatory to file even the entity has no employee OR dormant OR has not commenced business during the said calendar year.
Every employer shall, for each calendar year, prepare and render to his employee a statement of remuneration (EA for private sector employees; EC for public sector employees) on or before the last day of February of the following calendar year for each employee to complete and submit his/her personal tax return, including new, existing and resigned employees.
Good news! If any (1) of your director or business owner has an e-Filing PIN which registered to your business entity, then you are granted a grace period till 30 April 2017 to file your Form E online.
Failure in submitting Form E will result in the IRB taking legal action against the company’s directors. A minimum fine of RM200 (to RM20,000 or to imprisonment for a term not exceeding 6-months, or both) will be imposed by IRB for failure to prepare and submit the Form E to IRB.

- Issuance of Form EA to employees is from RM200 (RM212 W/GST) per headcount; with
- Review fee of the monthly payroll for the year is applicable to ensure disclosure in Form E is correct.
